HOLLY RIDGE  PARKS AND RECREATION COMMITTEE ORDINANCE


  BE IT ORDAINED, by the Town of Holly Ridge Town Council, Holly Ridge, North Carolina:

Section 1.  CREATION:  pursuant to the North Carolina General Statues, there is hereby created a Holly Ridge
Parks and Recreation Committee to perform the functions and duties herein described.

Section 2. PURPOSE: The purpose of the committee shall be to organize fund raisers and responsible for all
festivals and functions for the Town. Also to advise the Town Council of the needs, strengths and abilities of the
Town and its residents in relations to parks and recreation, and to undertake such action as may be appropriate
thereto.

Section 3: MEMBERSHIP AND VACANCIES: ATTENDANCE: The Parks and Recreation Committee shall consist of
nine (9) members appointed by the Town Council, and an unlimited number of volunteers. A majority of the
Committee shall be residents of the Town of Holly Ridge or its duly established extra-territorial jurisdiction area
(Amended May 12th, 2009) ; the members of the Committee shall serve for staggered terms of four (4) years.
Appointments to said staggered terms occurred upon the initial passage of the Article and the appointment
schedule as it presently exists is hereby ratified and adopted by Council as if fully set out herein.(Amended the 10th
day of August, 2004) Amended May 12th, 2009.

Section 4. QUORUM: A majority of the members consists of a quorum, and quorum must be present in any given
meeting in order to conduct official meetings.

Section 5. MEETINGS: Regular meetings of the Committee shall be held at the Community Building the first
Tuesday of every month at 7:00 p.m. (Amended May 12th, 2009) A written notice of the regular meetings shall be
filed with the Town Clerk by the Secretary of the Committee in compliance with the open meetings law of the State of
North Carolina. The committee shall hold at least one (1) meeting each month. All meetings shall be open to the
public. (Amended September 13, 1994) Special meetings may be called by the chairman or upon written request
from a majority of the committee.

Section 6. ORGANIZATION, RULES AND RECORDS: The committee shall elect a chairman, Secretary, and
Treasure for a term of one (1) year with eligibility for reelection. The elected chairman shall appoint a Co-Chairman
to conduct meetings in the absence of the chairman. The Secretary of the Committee shall keep accurate records
and minutes which shall be public record. The treasurer shall keep accurate records of all moneys and transactions
which shall also be public record. (amended September 13, 1994)

Election of officers shall be held at a regular meeting held in June of each year. New officers shall take office at the
regular July meeting each year.

Section 7. ATTENDANCE AT TOWN COUNCIL MEETINGS: The committee shall appoint at least one (1) member to
attend and report to the Town Council at such meetings as the Town Council may require from time to time and, in
any event at least quarterly.

Section 8. MISCELLANEOUS POWERS AND DUTIES: The committee may conduct such public hearings as may be
required to gather information necessary for the drafting, establishment, maintenance, and inquiry pursuant to
purposes for which the committee has been established.

Section 9. ANNUAL REPORT: The committee shall, in April each year, submit in writing to the Town Manager, a
report of its activities and an analysis of expenditures to date for the current fiscal year. It shall also submit to the
Town Manager for budget consideration any requested budget and a report indicating proposed activities for the
coming year.

Section 10. CONFLICTING ORDINANCES: All ordinances and/or regulations or parts of ordinances and/or
regulations in conflict with this ordinance are repealed only to the extent necessary to give this ordinance full force
and effect.

Section 11. EFFECTIVE DATE:  This ordinance amended at the Regular Meeting of the Parks And Recreation
Committee of Holly Ridge, North Carolina, March 2, 1999.

This ordinance was adopted on the 9th day of March, 1999 by the Holly Ridge Town Council.






                                       ARTICLE 3-2
   HOLLY RIDGE IMPROVEMENT AND APPEARANCE COMMITTEE


Be it ordained, by the Holly Ridge Town Council, Holly Ridge, North Carolina:

Section 1: CREATION
Pursuant to the North Carolina General Statues, there is hereby created a Holly Ridge Beautification Committee to
perform the functions and duties herein prescribed.

Section 2: PURPOSE
a.  The purpose of the Beautification Committee will be to advise the Town Council of improvements needed in
various areas of the Town to make Holly Ridge more attractive.

b.  Also, to plan and develop projects for the improvement and/or enhancement of the Town; to also pursue grant
funds available for beautification of the Town.

c.  Advise the Town of the maintenance/upkeep on any project such as watering, planting, weeding, etc.

Section 3.   MEMBERSHIP AND VACANCIES:  ATTENDANCES

The Beautification committee shall consist of five (5) members and unlimited number of volunteers. All shall be
residents of the Town of Holly Ridge or in the extraterritorial area, and shall be appointed by the Holly Ridge Town
Council; the members of the committee shall serve for terms of four (4) years, initial terms to be staggered as
follows:

          Member No. 1 - 4 years
          Member No. 2-  4 years
          Member No  3- 3 years
          Member No. 4- 3 years
          Member No. 5- 2 years


Vacancies occurring for reasons other than expiration of the term shall be filled as they occur for the unexpired
remainder of the term by the Town Council. Faithful attendance at meetings of the committee is to be considered a
prerequisite for continued membership, and the Town Council may remove and replace any member continually
delinquent in his duty to attend. The absence of any member from three (3) consecutive regular meetings without
leave, except when such absence is made necessary by sickness or other similar causes rules as emergency
nature, will declare vacant the seat of such member, in which event the vacancy thus created shall be filled by the
Town Council.


Section 4: QUORUM:

at the regular January meeting each year.

The Holly Ridge Town Council on September 11th, 2007 at the regular Town Council Meeting voted to delete
section 10. COMMUNITY BUILDING FUND ACCOUNT: The Chairman and the Treasurer of Parks and Recreation
shall be the only two authorized persons to write checks from the Holly Ridge Community Building Fund Account
after the Committee has approved a purchase or service. This decision was based on the fact that the fund was
closed out.





                                              ARTICLE 3-3
AN ORDINANCE REGULATING THE OPERATION AND USE OF THE PARKS
AND RECREATION FACILITIES OWNED AND CONTROLLED BY THE
                              TOWN OF HOLLY RIDGE


BE IT ORDAINED BY THE HOLLY RIDGE TOWN COUNCIL:

PURPOSE: The Purpose of this ordinance is to establish regulations for the public health, safety, and welfare in
respect to the recreational activities, programs and facilities of the Town of Holly Ridge. This ordinance is designed
to maximize the enjoyment of recreation in Holly Ridge’s recreation facilities and programs and offer protection from
conditions which could harm, injure or offend any group or individual.

SECTION 1.

It shall be unlawful for any person in any park, recreation area, playground, ball field, picnic shelter, or any other
recreation facility and the parking facilities thereof, owned or controlled by the Town of Holly Ridge.

  1. Willifully mark, deface, disfigure, injure, tamper with, display or remove any structure, equipment, facilities or
other property, either real or personal.

  2. Damage, cut, carve, transplant, or remove any tree or plant, injure the bark, pick the flowers or seeds of any
tree or plant, to dig or otherwise disturb grass areas in any other way, or injure or impair the natural beauty or
usefulness of any area.

  3. Dump, deposit or leave any bottles, broken glass, ashes, charcoal, gas, paper, boxes, cans, dirt, rubbish,
wastes, garbage or refuse, or other trash.

  4. Fail to obey all police officers and recreational personnel or volunteers, as appointed by the Town Manager or
his designee .

  5. Park any motor vehicle in areas other than established or designated parking areas.

  6. Drive any motor vehicle on any area except the parking areas or such other areas as may be specifically
designated by the Town Manager, or his designee. No motorcycles, mini-bikes, trail-bikes, dirt-bikes, go-carts, all
terrain vehicles, or like motorized vehicles are allowed on park property or any other recreational facilities, except
for parking in designated parking areas only.

  7. Allow or permit any dogs or other animals to run at large or to leave any excrement from such animal on any
area of the park or recreational facility.

  8. Violate the regulation that use of the individual gazebo, picnic shelter, together with tables and benches, follows
generally the rule of “First come, First serve”, unless a reservation has been issued according to regulations as
adopted by the Town Council.

  9. Leave a picnic area or shelter before the grill is completely extinguished and before all trash in the nature of
boxes, papers, cans, bottles, garbage and other refuse is placed in the receptacles provided. If no such receptacles
are available, then refuse and trash shall be carried away from the park area by the user to be properly disposed of
elsewhere.

  10. No person shall set up tents, shacks, or any other temporary shelter for the purpose of overnight camping, nor
shall any person leave in any park after closing hours any movable structure or special vehicle to be used or that
could be used for such purpose, such as a camper, house trailer, or the like.

  11. Bring or have in his/her possession, set off or otherwise cause to explode, discharge or burn any firecrackers,
other fireworks, explosives, or non-explosives, such as sparklers or discharge them or throw them into any such
area from land or highway adjacent thereto.

  12. Build or attempt to build a fire except when using the grill to cook. No person shall drop, throw or otherwise
scatter lighted matches, burning cigarettes or cigars, or other flammable material within any park area or on any
highway, road or street abutting or continuous thereto.

  13. Sleep or protractedly lounge on the seats, benches, floors or other area, or engage in loud, boisterous,
threatening, abusive, insulting or indecent language or engage in any disorderly conduct or behavior tending to be
a breach of the public peace.

  14. Disturb or interfere unreasonably with any other person or party occupying any area, or participating in any
unauthorized activity.

  15. Sell food, beverages, or merchandise or solicit donations for any individual, group, club company or
corporation without prior permission of the Town.

  16. Carry, use or possess firearms or dangerous weapons of any nature within any park, provided; however, this
section shall not apply to law enforcement officers when engaged in the discharge of their duties.

  17. Enter, use or remain within any park between the hours of 10:00 pm and 8:00 am unless a Town sponsored
event is delayed or a written permit therefore has been obtained from the Town Manager or his designee.

  18. Bring upon, possess, consume or display any beer, wine, whiskey or other intoxicating liquor or beverage or
controlled substances or the containers thereof within the confines of any park and recreation areas. It shall be
prohibited for a person under the influence of alcohol or any controlled substance to enter or remain in a recreation
facility or program and such person or persons shall immediately leave upon the request of a police officer,
recreation personnel, designated volunteers or other persons specified.

SECTION 2.

  1. No open fires are allowed. All fires must be contained in a grill provided by the Town.

  2. Flagrant misuse of parks and recreational facilities will result in forfeiture of future sue and reservation
privileges.

  3. The Town Manager and the Recreation and Appearance Committee have the authority and responsibility to
recommend rules and regulations governing the use and maintenance of parks and recreational facilities to the
Holly Ridge Town Council for their consideration.

  4. Any requests for special events or use of the parks and recreational facilities shall be presented to and
approved by the Town Manager or his designees. If these requests are approved, a permit will be issued and any
fees will be assessed by the Town Manager or his designee.

SECTION 3.

Any section or part of any park, recreation area or facility may be declared closed to the public by the Town of Holly
Ridge at any time and for any interval of time, either temporarily or at regular and stated intervals (daily or
otherwise) and closed to certain uses.

SECTION 4.

  1. Users of all parks and recreation facilities shall adhere to this ordinance, and also to all rules and regulations
set by the Holly Ridge Town Council.

  2. The Town Manager or his designee and any authorized Town employee and any law enforcement agency shall
have the authority to eject from any recreation facility, any person acting in violation of other rules and regulations
enacted pursuant to this ordinance by the Recreation and Appearance Committee as adopted by the Holly Ridge
Town Council.

SECTION 5.

Any person who shall violate the provisions of this ordinance shall be guilty of a misdemeanor punishable by a fine
or not more than $150.00, or imprisonment of not more than thirty (30) days, or both, in the discretion of the court,
as provided by section 14-4 of the General Statues of North Carolina.

ORDINANCE REGULATING THE USE OF MORRIS LANDING PARK

BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF HOLLY RIDGE, THAT ARTICLE 3 TITLED “HOLLY RIDGE
PARKS AND RECREATION COMMITTEE“, BE AMENDED TO ADD ARTICLE 3-4

BE IT ORDAINED BY THE HOLLY RIDGE TOWN COUNCIL, that the North Carolina Coastal Federation purchased
fifty two acres at Morris Landing and Mr. Skrabal and Ted Wilgis, representatives from the Coastal Federation, was
present at the October 12th, 2004 Council meeting to ask the Council if they would consider the possibility of the
upkeep of the Morris Landing area which would be the routine maintenance, repair, policing and clean-ups of the
area.

WHEREAS, during the Regular Meeting of the Holly Ridge Town Council on December 14th, 2004, a motion was
offered by Councilman Maloney and was seconded by Councilman Summerlin, to agree to assist the Coastal
Federation on the project at Morris Landing with the upkeep of the Landing and it would fall under the Town’s
jurisdiction. Within this motion, Councilman Maloney also called for a public hearing for the satellite annexation of
the fifty two acres at Morris Landing. July 12th, 2005, the Holly Ridge Town Council held a public hearing for
comments, and with a vote of four to one, the motion was passed to satellite annex the fifty two acres owned by the
NC Coastal Federation, and to maintain the Landing.

Section 1. Regulations

  It shall be unlawful for any person in the park and the facilities thereof, owned or controlled by the Town of Holly
Ridge

          1. To dive or jump off pier
          2. To Litter
          3. To possess alcoholic beverages
          4. To park in “No Parking” areas
          5. To possess food or drink containers beyond posted signs
          6. To camp (exemption by permit from Town Manager)
          7. To start a fire
          8. To possess firearms
          9. To remove or cut vegetation
          10. To have vehicles or bicycles on pier (exception handicapped conveyance)
          11.  To cause damage to real property
          12. To drive any motor vehicle on any area except the parking areas or such other areas as may be
specifically designated
          13. To allow or permit any dogs or other animals to run at large or to leave any excrement from such animal
on any area of the park or facility.

Section 2. Penalty

  Any person violating any provisions of this chapter shall be subject to a civil penalty of not mare than $500.00
after notification of violation. Each day of a continuing violation shall constitute a separate violation. Any person who
violates any provision of this chapter shall be deemed guilty of a misdemeanor punishable pursuant to NCGS 14-4.
Each day continuing violation shall constitute a separate violation.

Section 3. Conflicting Ordinances Repealed

  All ordinances in conflict with this ordinance are repealed only to the extent necessary to give this ordinance full
force and effect.

Section 4. Severability

  If any one or more of the terms, provisions, covenants or restrictions of this ordinance shall be determined by a
court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the terms provisions,
covenants, and restrictions of this shall remain in full force and effect and shall in no way be affected, impaired or
invalidated. If, moreover, any one or more of the provisions contained in this competent jurisdiction to be excessively
broad as to duration, geographical scope, jurisdiction to be excessively broad as to duration, geographical scope,
activity or subject, it shall be construed, by limiting or reducing it, so as to be enforceable to the extent compatible
with then applicable law.

Section 5. Effective Date

  This ordinance shall become effective upon the 14th day of November 2006.
